1.1 This is the privacy policy ("Policy") of Chronos Manufactures SA, Bundesstrasse 6, 6300 Zug, Switzerland ("Chronos Manufactures", "we", "us", "our"). Chronos Manufactures is the responsible party for the purposes of this Statement.

1.2 This Statement, together with our Terms of Use, forms the basis on which we process any personal data we obtain in connection with your use of and interaction with this website or any other online presence managed by us, including our social media presences and our applications (together referred to as the "Website"). 2. WHAT PERSONAL DATA DO WE COLLECT?

2.1 We collect personal data that you provide to us, for example, by completing a contact form, registering for an account, using interactive features, signing up for a service, participating in a marketing promotion, ordering a product or service, requesting information and/or materials, or participating in surveys. Such personal data may consist of:

2.1.1 Contact details (e.g. name, address, email address, mobile or other telephone number);

3. ON WHAT BASIS DO WE PROCESS YOUR PERSONAL DATA?

3.1.1 to which you have consented, for example by ticking a box; or

3.1.2 which we are obliged to do under applicable law, e.g. to comply with data retention requirements relevant to accounting; or

4. FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

4.1 We process your personal data for the following purposes:

4.1.1 If you fill in a contact form with your name, email address, phone number, preferences, etc., we will use your data to answer your questions, send you information or perform other tasks you ask us to do.

4.1.2 If you create an account with us, we will process the data required to open that account, e.g. your name, address, email address, password, profile picture, third party account details (e.g. if you register via your Facebook account), etc. to enable you to log in and manage your account.

4.1.3 If you use our interactive features, we process the data necessary for the use and management of these features, e.g. to display your name and email address in a ranking and to send you updates about the online game you have participated in.

4.1.4 If you are already a customer, we may send you advertisements about our products and services using, for example, your name and address.

4.1.5 If you subscribe to a service such as our newsletter by providing us with your email address and name, we will use this information to send you our newsletter.

4.1.6 If you participate in a marketing promotion, we use the data we need from you to enable your participation, for example to manage your invitation to an event or to identify and contact the winner of a competition.

4.1.7 When you order a product, material or service, we require and process the data necessary to fulfil your order, such as your name, telephone number, delivery address, credit card information, email address, etc., to confirm your order, process your payment, check creditworthiness, deliver the items ordered and contact you for delivery purposes.

4.1.8 If you respond to one of our enquiries and provide us with personal information such as name, age, occupation etc., we will use this information to analyse the feedback and draw conclusions.

4.1.9 If you agree to receive marketing information, we will use your information to send you promotional materials and other communications, to inform you about and manage your participation in special events, contests, sweepstakes, programs, offers, surveys and market research, to send you advertisements about our products and services, to customise your use of the Site, marketing experience and communications according to your preferences and our terms.

4.1.10 If you interact with us on third party social networks, then we process your data for such interactions with you on those networks (interactions on a third party social network are subject to that network's privacy policy and terms of use).

4.1.11 We also process your personal data to comply with and enforce applicable legal requirements, our terms of use, relevant industry standards, contractual obligations and our policies.

4.2 We may process your personal data in a central system that enables us to improve your brand perception by tailoring our communications and marketing efforts to be as relevant and useful to you as possible (profile building). To do this, we may process, match and supplement your personal data with data from your interaction with us or data from third parties. For example, if you tell us your age, income, hobbies or travel activities, we may match this data with your purchasing behaviour and other information we have received from you in order to send you offers, invitations or promotions that we think are particularly relevant to your interests.

4.3 We process metadata we collect from you to improve our website, analyse visitor behaviour and website usage, for targeted marketing, to develop and analyse statistics and demographic data or to optimise our online presence and marketing activities.

 
5. WHO DO WE DISCLOSE AND TRANSFER YOUR PERSONAL DATA TO?

5.2 We may disclose your personal data to the following recipients or categories of recipients who act on our behalf and/or as partners (processors), but limited to the purpose of fulfilling their obligations, and who are contractually obliged to maintain an adequate level of data protection when processing your personal data (for example. e.g. to fulfil orders, deliver parcels, process credit card payments, provide customer service, send mail and email, store and process data, host websites, remove repetitive data from customer lists, analyse data, provide marketing support, conduct customer satisfaction surveys, provide customised advertising):

5.3 We may disclose your personal data to an acquirer if Chronos Manufactures or a substantial part of its assets are acquired by a third party, where the personal data held by that company about its customers is one of the transferred assets.

5.4 We may disclose your personal data if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or to enforce or apply our terms of use and other agreements; or to protect the rights, property or safety of Chronos Manufactures or any member of Chronos Manufactures SA, our customers or others. This includes sharing data with other companies and organisations to protect against fraud and reduce the risk of failure.

5.5 We may transfer your personal data across borders, including to countries that do not provide an adequate level of data protection according to the relevant supervisory authorities, e.g. countries that do not provide such a level according to the European Commission or the Federal Data Protection and Information Commissioner. In this case, we will ensure the adequate protection of your personal data by requiring the recipients to comply with binding contractual obligations in accordance with the applicable standards approved by the competent supervisory authorities or by relying on other safeguards, such as self-certifications, approved by the competent supervisory authorities. 6. HOW LONG DO WE PROCESS YOUR PERSONAL DATA?

We process your personal data:

    until you withdraw your consent to further processing, e.g. until you unsubscribe from our newsletter or delete your account with us;

    until we are satisfied that you are happy after you have contacted us, e.g. to order a catalogue, ask a question, request information, make an appointment or a reservation, etc., but no longer than twelve (12) months after the last contact, unless we can rely on another justification, have informed you otherwise or you have given your consent for a longer storage period;

    in connection with a purchase you have made or in connection with a customer service transaction, during the period up to the completion of the transaction plus at least the warranty period to which we may add a grace period for your benefit, unless we can rely on another justification, have informed you otherwise or you have given your consent for a longer retention period;

    for as long as you remain our business partner and for a further ten years, unless we can rely on another justification, have informed you otherwise or you have given your consent for a longer retention period;

    for as long as required by law, e.g. legal retention obligations due to accounting or tax regulations.

7. WHEN DO WE NEED YOUR PERSONAL DATA?

If you wish to enter into a contract with us, e.g. if you order items or services, we are required to collect certain personal data from you in order to enter into that contract, e.g. your name, delivery address, place of residence, payment information or contact information. If you choose not to provide us with the required information, we will not be able to enter into this contract with you.

 
8. WHAT ARE YOUR RIGHTS?

8.1 You have the right to:

    request from us information about, rectification or erasure of your personal data;
